Probation Issues

PROBATION ISSUES – In many ways, violation of probation cases are much more serious than the underlying offense.

The burdens of proof are lower for the State.

The rules of evidence are more relaxed.

In other words, it’s easier for the State to put you in jail for a VOP than for the original offense.

And…to make matters worse, the judges often take it personally that you didn’t comply with you promise to “behave.”

This can result in harsher penalties than you got in the first place.

Don’t think that just because you like your probation officer (or think they like you) that things will “go easy” in court.
